Conversion of residential space into to office space

It is often the case that certain persons carry out their business in a residential space, and in order to get certain benefits, they need to convert and register that space as office space in the Cadastre.

In this regard, we prepared short guide through six defined steps that can help you with this.

  • Step 1 – Conceptual Solution

In order to start the process of transforming the purpose of your space from residential to office space, first it is necessary to prepare a Conceptual Solution.

The development of the Conceptual Solution is carried out by a designer hired by you as an investor and owner of the space that is the subject of conversion from residential to office space. Also, during the further proceedings, the designer will submit requests on your behalf to the competent authorities via the CIS (information system through which the unified procedure is carried out electronically) in the form of an electronic document that is signed with a qualified electronic signature.

  • Step 2 – Location Conditions

Location Conditions are document issued at your request by the Municipal authority in charge for urban planning and construction on the territory of which the space that is subject to this proceeding is located.

Location Conditions are required document because it contains urban planning conditions, technical conditions, other conditions and data required for the preparation of the Conceptual Project, the Project for a Building Permit or the Project for Execution.

The proceedings for obtaining Location Conditions is initiated by submitting a request to the competent authority through the CIS as explained above.

Along with the request for obtaining the Location Conditions, it is necessary to submit the following:

  • Conceptual Solution (Step 1),
  • proof of the administrative fee payment.

If all the conditions are met, the competent authority will issue the Location Conditions within 5 working days from the date of submitting the request.

  • Step 3 – Conceptual Design

The Conceptual Design represents the concretization of the Conceptual Solution (Step 1), which is prepared by your designer based on the Location Conditions (Step 2).

The Conceptual Design is submitted to the competent authority as part of the necessary technical documentation, along with the request for a Decision on Approval for the Execution of Works which is the next step of this proceedings.

  • Step 4 – Decision on Approval for the Execution of Works

In the process of converting the use of space from residential to office space, it is necessary to obtain a Decision on Approval for the Execution of Works. Please note that obtaining this Decision is necessary even if the actual performance of works is not required.

The request for obtaining the Decision on Approval for the Execution of Works is submitted by the designer through CIS. Conceptual Solution (Step 1), Location Conditions (Step 2), Conceptual Design (Step 3), and proof of payment of the fees must be enclosed to this request.

  • Step 5 – Decision on Conversion

The Decision on Conversion is the essence of this proceedings because it is the basis for registering the change of use of your space in the Cadastre.

The request for rendering the Decision on Conversion is submitted to the Municipal Administration – Department in charge of construction, communal and property-legal affairs, in the manner described above.

The documents explained in the previous four steps (Conceptual Solution, Location Conditions, Conceptual Design, Decision on Approval for the Execution of Works) must be enclosed to this request.

  • Step 6 – Registration in the Cadastre

The last step in this proceedings is the registration of the space conversion from residential to office space in the Cadastre.

Based on your request and enclosed Decision on Conversion, the Cadastre will register the change of your space from residential to office space.

The request should be submitted to the Cadastre on the prescribed form and the Decision on Conversion (Step 5) must be enclosed to this request, as well as proof of the payment of administrative fees.
