Special Collective Agreement for Construction and Industry of Construction material of Serbia

The Union of Employers of Serbia and the Union of Construction Workers and Construction Material Industry concluded a Special Collective Agreement for Construction and Industry of Construction Material of Serbia, which entered into force on 18 May 2023 (hereinafter “Collective Agreement”).

This Collective Agreement was the first signed in the private sector this year, and it regulates the rights, obligations and responsibilities of employees and employers in the construction industry for a period of one year.

Pursuant to Paragraph 2 Article 121of the Collective Agreement, a Social Dialogue Committee is formed, which has several key functions for the implementation of this Collective Agreement, as follows:

  • monitoring the implementation of the Collective Agreement itself;
  • providing opinions, instructions and procedures related to the implementation of the provisions of the Collective Agreement;
  • performing other tasks related to the implementation of this Collective Agreement (which includes all additional tasks and activities necessary to ensure the effective implementation of the agreement).

In addition, in accordance with Paragraph 2 of Article 130, of the Collective Agreement, the participants in the conclusion of this Collective Agreement shall jointly submit a request to the Government of the Republic of Serbia for its application to employers who are not members of the Union of Employers of Serbia, in accordance with Article 257 of the Labor Law.

This is an important provision because in the event that the Government of the Republic of Serbia adopts the request, the Collective Agreement would apply to all employers in the construction and industry of construction materials, regardless of whether they are members of the Union of Employers of Serbia, and that the rights and obligations set out in the Collective Agreement apply to all workers in this industry, thus protecting their status and ensuring equal treatment of all employees.
