Implementation of the Regulation on Electronic Archiving Postponed

The Law on Archival Material and Archiving Activities („Official Gazette of the RS“, no. 6/2020) („Law“) –  is being implemented as of February 2021.

As one of the supporting bylaws, the Regulation on Technical and Technological Requirements and Procedures to be Fulfilled by Creators and Owners of Archival Material and Documentary Material in Electronic Form (“Official Gazette of RS”, no. 107/2021 and 94/2022) (“Regulation“) was adopted and entered into force on 25 August 2022.

The Regulation addresses the matter of “electronic archiving”, i.e. the storage and protection of archival material and documentary material in electronic form, the design of the “eArchive” software, and other obligations related to electronic archiving and delivery of documentary material in electronic form to the public eArchive.

When it comes to the subject of the Regulation, i.e., the electronic archiving and creation of the eArchive, the implementation was planned as of 1 September 2022.

However, according to the latest amendments the implementation of the Regulation has been postponed until 1 January 2024, and until the start of the implementation of the Regulation and the provision of conditions for electronic archiving and storage of archival materials in the eArchive, these obligations will be carried out according to the provisions of the Law.
