Amendments of the Public Enforcement Officer Tariff

Amendments of the Public Enforcement Officer Tariff (hereinafter: “Tariff“), which prescribe an increase of the fees for public enforcement services, came into force on 4 March 2023. According to the Enforcement and Security Act, the Tariff is exclusively determined by the Minister of justice, and therefore the Tariff determination is not subject to the parliamentary or any other form of public discussion.

The fee for the work of a public enforcement officer is determined by multiplying the number of points provided for a particular service by the value of the point and adding value-added tax (VAT). The fees paid to the public enforcement officer are (i) the public enforcement officer fee for the preparation, management, and archiving of cases, (ii) the public enforcement officer fee for the successful perfromance of enforcement, and (iii) the public enforcement officer fee for individual services, including fee for personal delivery of the enforcement order to the debtor, fee for posting on the court notice board, fee for delivery of documents by mail, fee for obtaining information from state authorities and public authority holders and etc.

.Firstly, the value of the point has increased from RSD 120 to RSD 150, and consequently, the total amount of each public enforcement service, for which a fee is paid, has increased by quarter.

Furthermore, the public enforcement officer fee for delivering documents by mail to parties, participants in the proceedings, the court, state authorities, legal entities, entrepreneurs, and public authority holders. is 3.5 points, compared to 2.5 points prescribed in the previous tariff, and the reason for the increase in the point amount is the recent increase in postal services prices. For example, the amount of RSD 300 without VAT (RSD 120 x 2.5 points) will no longer be paid for the delivery of documents by mail, but the amount of RSD 525 without VAT (RSD 150 x 3.5 points), i.e. RSD 630 VAT included which represents a 75 percent price increase, and refers to the delivery of only one submission.

The Tariff will not be applied retroactively, i.e. it will only apply to enforcement and security proceedings initiated from the date of the Tariff’s entry into force.
